Terms of Service

These Terms of Service (“Terms”) govern your use of the Driving Range app on Garmin watches and on iPhone, and the website at golfwatch.app (collectively, “the Service”).

By installing or using the Service, you agree to these Terms. If you do not agree, do not install or use the Service.

1. The Service

Driving Range is a swing-tracking application for golf practice on Garmin watches, with an optional iOS companion app for reviewing sessions, viewing trends, and accessing additional coaching features. The watch app is distributed through the Garmin Connect IQ Store; the iOS companion is distributed through Apple’s App Store.

We provide the Service “as is” and may add, remove, or change features at any time.

2. Your account and your data

The Service does not require an account. Swing and session data is recorded locally on your watch and (if you install the iOS companion) on your paired iPhone. You are responsible for keeping a backup of any data you wish to preserve.

How we handle data is described in our Privacy Policy.

3. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service, except to the extent local law expressly permits.
  • Modify or create derivative works of the Service.
  • Use the Service to violate any applicable law or to infringe on anyone’s rights.
  • Attempt to interfere with the Service’s normal operation, including by submitting deliberately malformed data to the watch–phone bridge.

4. Premium Coaching subscription (iOS)

The iOS companion app offers an optional auto-renewing subscription called Premium Coaching, available as a monthly or annual plan. The following terms apply when you subscribe:

  • Billing. Payment is charged to your Apple ID account at the price shown at confirmation of purchase. Your subscription automatically renews at the end of each period unless you cancel at least 24 hours before the end of the current period.
  • Renewal price. Subscriptions renew at the same price you originally paid unless we notify you of a price change in advance, as required by Apple’s policies.
  • Cancellation. You can cancel any time in Settings → Apple ID → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period; you keep premium access until then.
  • Refunds. Refund requests are handled exclusively by Apple under Apple’s refund policy. We cannot issue refunds directly.
  • Free trials and promotional offers. If a free trial or introductory price is offered, it is available only to new subscribers, only once per Apple ID, and converts automatically to the standard renewal price unless you cancel before it ends.
  • Changes to plans. We may add, remove, or change the available plans and their prices for new subscribers. Existing subscribers will be notified before any change to their renewal price.

5. Donations

Donations made through the Donate page are processed by PayPal. They are not refundable, do not entitle you to any premium features, and do not create any commercial relationship between you and us beyond a heartfelt thank-you.

6. Intellectual property

The Service, including its code, design, copy, and visual assets, is owned by the developer and is protected by copyright and other intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive licence to use the Service in object-code form on devices you own or control, solely for personal, non-commercial purposes.

You retain ownership of the swing data you generate.

7. Third-party services

The Service relies on third-party platforms — Apple’s iOS, Garmin’s Connect IQ, the App Store, the Connect IQ Store, PayPal — whose own terms and privacy policies apply to your use of those platforms. We are not responsible for the availability, performance, or behaviour of those third parties.

8. Disclaimers

The Service is provided as is and as available, without any express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, nor that swing scores or coaching tips are accurate, complete, or appropriate for your specific situation.

The Service is a practice aid, not a medical or fitness diagnosis tool. Use common sense when interpreting any output, and consult a qualified coach or medical professional for advice tailored to you.

9. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising out of or in connection with your use of (or inability to use) the Service. The developer’s total liability for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the claim, or (b) ten euros.

Some jurisdictions do not allow the limitation or exclusion of certain warranties or liabilities; in those jurisdictions, the limitations above apply only to the extent permitted by law.

10. Termination

You may stop using the Service at any time by uninstalling it. We may suspend or terminate your access to the Service if you breach these Terms or if we are required to do so by law.

If you have an active subscription at the time of termination by us, we will refund any unused, prepaid portion of the current billing period through Apple where reasonably possible.

11. Governing law

These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be brought exclusively in the competent courts of Cyprus, except where mandatory consumer-protection law in your country of residence provides otherwise.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top and, where the change is material, announce it in the app’s release notes. Continued use of the Service after a change constitutes acceptance of the revised Terms.
